Established in 1962, Board of Adjustment is a quasi-judicial board.
The Board consists of seven members, appointed by the mayor, subject to confirmation by a majority of city council, for a two-year term. Meetings are held the fourth Monday of each month at 6:00 pm as necessary. Each case before the Board must be heard by at least 75% of its members. All meetings are open to the public.
Responsibilities and Duties
Hear and decide an appeal that alleges error in any order, requirement, decision, or determination made by an administrative official in the enforcement of zoning regulations or an ordinance adopted under zoning regulations;
Hear and decide special exceptions to the terms of a zoning ordinance when the ordinance requires the Board to do so;
Authorize in specific cases a variance from the terms of a zoning ordinance if the variance is not contrary to the public interest, and, due to special conditions, a literal enforcement of the ordinance would result in unnecessary hardship, and so that the spirit of the ordinance is observed and substantial justice is done;
Hear and decide other matters authorized by an ordinance adopted under the zoning regulations.
